1. Scope

1.1 These General Terms and Conditions (hereinafter referred to as "GTC") of Fulanis Hair (hereinafter referred to as "Seller") apply to all contracts concluded by a consumer or entrepreneur (hereinafter referred to as "Customer") with the Seller regarding the goods offered by the Seller in its online shop. Any inclusion of the Customer's own terms and conditions is hereby expressly rejected unless otherwise agreed.

1.2 These GTC also apply to the purchase of vouchers, unless explicitly stated otherwise.

1.3 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity.

1.4 An entrepreneur is a natural or legal person, or a legally capable partnership, who acts in the exercise of their commercial or independent professional activity when concluding a legal transaction.

2. Conclusion of Contract

2.1 The presentation of goods, especially in the online shop, does not yet constitute a binding offer by the Seller.

2.2 First, the Customer places the selected goods in the shopping cart. In the next step, the ordering process begins, during which all required data for processing the order are collected. At the end of the ordering process, a summary of the order and contract data is displayed. Only after confirming this summary by clicking the button that completes the ordering process does the Customer submit a binding offer to purchase the goods in the shopping cart.

2.3 The Seller may accept the Customer’s offer through the following alternatives:

  • Sending a written order confirmation or confirmation in text form (email), or

  • Requesting payment from the Customer after placing the order, or

  • Delivering the ordered goods.

The time of acceptance is determined by the first alternative that occurs. The period for acceptance begins the day after the Customer submits the offer and ends at the close of the fifth day following submission. If the Seller does not accept the Customer’s offer within this period, this constitutes a rejection of the offer, and the Customer is no longer bound by their declaration of intent.

2.4 If the payment method "PayPal" or "PayPal Express" is selected, payment is processed through the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"). The PayPal User Agreement applies: https://www.paypal.com/de/webapps/mpp/ua/useragreement-full. Customers without a PayPal account can view the terms here: https://www.paypal.com/de/webapps/mpp/ua/privacywax-full.

By selecting "PayPal" or "PayPal Express," or by paying via one of the PayPal payment methods (e.g., credit card via PayPal, Apple Pay via PayPal), the Customer submits their offer by clicking the order button. If the Customer simultaneously authorizes PayPal to process the payment, the Seller considers the Customer’s offer accepted at the time of the payment authorization.

2.5 The contract text of each contract concluded between the Seller and the Customer is stored by the Seller. The GTC can be viewed by the Customer at any time on this page. Order data, withdrawal instructions, and the GTC are sent to the Customer by email. After completing the order, the contract text is available to the Customer free of charge through their customer login, if they have created a customer account.

2.6 All entries are displayed before clicking the order button and can be reviewed and corrected by the Customer using the browser's back button or standard mouse and keyboard functions. If available, correction buttons are also provided.

2.7 The contract language is German.

2.8 The Customer is responsible for providing a correct email address for order processing and ensuring that emails relating to the order can be received.

3. Prices and Payment Terms

3.1 Displayed prices are final prices including statutory VAT unless stated otherwise. Additional shipping costs, if any, are noted in the product description.

3.2 For deliveries outside the EU, additional customs duties, taxes, or fees may apply and must be paid by the Customer. Customers are advised to check these details with the relevant authorities prior to ordering.

3.3 Customers can select from the payment methods available in the online shop.

3.4 Payments via "PayPal" are processed by PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg. PayPal’s terms of use apply.

3.5 PayPal Checkout may also include services from third-party providers.

3.6 Payments via "PayPal Direct Debit" are processed via a SEPA direct debit mandate. If insufficient funds or incorrect bank details prevent payment, the Customer bears the resulting fees.

3.7 Payments by invoice via "PayPal Invoice" are due 30 days after receipt of the goods. Assignment of claims to PayPal is agreed.

Payment methods available:

  • Credit Card (Visa, Mastercard, Amex)

  • PayPal

  • Apple Pay

4. Delivery and Shipping Terms

4.1 Delivery is made to the address provided by the Customer. If PayPal is used, the address stored there is binding.

4.2 Incorrect addresses or refusal of delivery will incur additional costs borne by the Customer.

4.3 Self-collection is excluded.

4.4 Vouchers are sent digitally (email or download) or by post.

5. Right of Withdrawal

5.1 Consumers generally have the right to withdraw.

5.2 Fulanis Hair’s withdrawal policy applies. Opened or worn wigs are excluded for hygiene reasons.

6. Retention of Title

If the Seller provides goods in advance, ownership remains with the Seller until full payment is received.

7. Liability for Defects

7.1 The statutory provisions on liability for defects apply.

7.2 Obvious transport damage must be reported to the carrier and Seller immediately.

8. Liability

8.1 The Seller is fully liable in cases of intent or gross negligence.

8.2 For slight negligence, the Seller is only liable for damage to life, body, or health or for breach of essential contractual obligations.

8.3 Liability is limited to typical, foreseeable damages.

8.4 Further claims are excluded.

8.5 The above liability rules also apply to the Seller’s legal representatives and vicarious agents.

9. Redemption of Gift Vouchers

9.1 Gift vouchers may only be redeemed in the Seller’s online shop.

9.2 Vouchers and remaining balances are valid until the end of the third year after purchase.

9.3 Vouchers can only be redeemed before completing the order.

9.4 Only one voucher may be used per order.

9.5 Vouchers cannot be used to purchase additional vouchers.

9.6 If the voucher value is insufficient, another payment method may be used.

9.7 Balances are non-refundable and non-interest-bearing.

9.8 Vouchers are transferable.

10. Redemption of Promotional Vouchers

10.1 Promotional vouchers may only be redeemed in the online shop and within the specified period.

10.2 They are redeemable only by consumers.

10.3 Certain products may be excluded.

10.4 Only one promotional voucher per order.

10.5 The order value must at least match the voucher value.

10.6 Remaining balances are not paid out.

10.7 Combining multiple vouchers is not permitted.

10.8 The voucher expires if the order is withdrawn.

10.9 Transfer is excluded.

11. Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

12. Jurisdiction

If the Customer is a merchant, a public-law entity, or public-law special fund, the place of jurisdiction is the Seller’s registered office.

13. Information on Online Dispute Resolution

The EU Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr.

Fulanis Hair is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
